The Board of Claims (Board) and Old-castle Precast Modular Group, McGregor Industries, Inc., Lighthouse Electric Co., Inc., C&M Contracting, Inc., W.G. Tomko, Inc., Kirby Electric, Inc. and Miller Bros. Construction, Inc. (collectively, Respondent Contractors) have filed preliminary objections to the petition for review in the nature of a complaint for declaratory judgment filed in the Court’s original jurisdiction by the Department of General Services (DGS) on February 10, 2005. DGS filed its action under the Declaratory Judgments Act, 42 Pa.C.S. §§ 7531-7541.…
