*692In an action to recover damages for legal malpractice, etc., the defendants appeal, as limited by their brief, from stated portions of an order of the Supreme Court, Suffolk County (Tanenbaum, J.), dated March 18, 2004, which, inter alia, denied their motion to dismiss the complaint pursuant to CPLR 3211 (a) (5).

Ordered that the order is reversed insofar as appealed from, on the law, with costs, the motion is granted, and the complaint is dismissed.
