BECKER, District Judge.

This cause comes to Division No. 4 on reassignment as a result of the recent vacancy in Division No. 1. The plaintiff Lewis, who is a citizen of Missouri, and his subrogated insurer, instituted this action in the Circuit Court of Jackson, County, Missouri (at Kansas City) against Producers Cooperative Oil Mill, an Oklahoma corporation, and the St. Louis-San Francisco Railway Company (hereinafter referred to as Frisco), a Missouri corporation.
