Action in the municipal court of St. Paul to recover-$ioo as commission for procuring a purchaser for defendant’s real estate. The case was tried before Hiñe, J., who- granted defendant’s motion to dismiss, upon■ conclusion of plaintiff’s testimony. From an order denying a motion for new trial plaintiff appealed.

The complaint alleges that defendant authorized and requested plaintiff to secure a purchaser for a certain house and lot in the city of St. Paul for the sum of $1,900, and agreed to pay for such services a commission of $100; that plaintiff, through his agent, Daniel Kelly, procured a party (Mr. Donovan) who was ready and willing to buy the property; and that defendant personally entered into a contract with him which resulted in selling him the premises for $1,850; and the action was brought for the purpose of recovering the commission.
