MEMORANDUM OPINION

LEON, District Judge.

Plaintiff, Albert N. Maiden, brought this action against the Commissioner of Social Security, Jo Anne B. Barnhart (“Commissioner” or “Secretary”), seeking judicial review of a decision on July 15, 2004, of the Appeals Council of the Social Security Administration (“SSA”) upholding an administrative law judge’s (“ALJ”) dismissal of plaintiffs untimely request for a hearing. 0See A.R. 144-47.) Currently before the Court is defendant’s Motion to Dismiss plaintiffs Complaint on the ground that this Court lacks subject-matter jurisdiction to hear the case.…
