This appeal is from a summary judgment rendered in an action brought in the United States District Court for the Eastern District of Louisiana against Continental Grain Company (Continental) by Peter Mahfood to recover damages for personal injuries under the Federal Employers’ Liability Act (FELA), 45 U.S.C. §§ 51-60 (1976). The district court granted Continental’s motion for summary judgment on the basis that it was not a common carrier railroad as contemplated by 45 U.S.C. § 51.
