MEMORANDUM OPINION
COBB, District Judge.
This is a personal injury case in which Plaintiff Jerry Nichols complains of per manent injuries sustained while in the employ of Defendant Pabtex, Inc. (“Pabtex”). He seeks recovery against Pabtex and The Kansas City Southern Railway Company (“KCSR”) and its parent Kansas City Southern Industries, Inc. (“KCSI”) under the Federal Employers Liability Act, 45 U.S.C. § 51 (“FELA”), the Safety Appliance Act, 45 U.S.C. § 51 (“SAA”), the Texas Railroad Liability Act (“TRLA”), Tex.
