This case is before the Court on Defendant’s motion to dismiss, or in the alternative, for summary judgment. The case presents Fifth Amendment taking issues arising from the activities of the United States Border Patrol (“Border Patrol”) on Plaintiffs 100-acre property, located in southern California near the border with Mexico.
