MEMORANDUM AND ORDER
DEARIE, District Judge.
This action was brought under Section 515 of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1145 and Section 301 of the Labor Management Relations Act (“LMRA”), 29 U.S.C. § 185, to collect contributions allegedly due and owing to employee benefit trust funds under a collective bargaining agreement concededly entered into between an employer and a union.
