Southwest Administrators, Inc., an employee benefit trust fund administrator, brought this action against Rozay’s Transfer, an employer, to recover allegedly delinquent trust fund contributions. Rozay’s Transfer contends Teamsters Local 208 fraudulently induced it to execute the underlying collective bargaining agreement and thus Rozay’s Transfer has no obligation to pay retroactive contributions.
