Action for damages for personal injuries. .Originally there were two defendants, the Kansas City Public Service Company, a corporation operating a street car system in Kansas City and the Gate City Oil Company, a corporation! engaged in the sale and distribution of gasoline, oil and other commodities in said city. At the close of plaintiff’s evidence the court sustained a demurrer as to the Public Service Company and plaintiff thereafter dismissed as to- that defendant.
