Suit for $35,000 damages for alleged personal injuries received by the plaintiff in a collision between his automobile and one driven by the defendant. The defendant’s answer pleaded contributory negligence. The plaintiff, attempting to avoid that issue, sought to submit the ease solely on the humanitarian doctrine, but the trial court refused to give his instruction on that theory. He thereupon went to the jury with only one instruction— on the measure of damages — and the verdict -was against him.
