McKENNA, District Judge.
Plaintiff Deere & Company (“Deere”) initiated this action by filing the Complaint, along with an Order to Show Cause seeking a Preliminary Injunction and a Temporary Restraining Order, on April 1, 1994. Plaintiff alleges that the actions of Defendant MTD Products, Inc. (“MTD”), in broadcasting or causing to be broadcast the television commercial at issue, violate Section 43 of the Lanham Act, 15 U.S.C. § 1125(a), and the New York anti-dilution law, N.Y.Gen.Bus.
