This is an appeal from an order of the United States District Court for the Southern District of New York, Sweet, J., granting the motion for summary judgment by the defendants, Nintendo Co., Ltd. and Nintendo of America, Inc. (Nintendo), in the action brought by plaintiff Universal City Studios, Inc. (Universal) under section 43(a) of the Lanham Act, 15 U.S.C. § 1125(a) (1982), the New York anti-dilution statute, N.Y.Gen.Bus.Law § 368-d (McKinney 1984), and common law unfair competition, trademark and trade name principles.
