Plaintiff New York News, Inc. (“the Daily News”) brought this action by order to show cause, seeking, inter alia, a preliminary injunction enjoining the defendants, the State of New York, the New York Department of Labor, Thomas Hartnett, Martin F. Scheinman, Fred L. Denson and Thomas F. Carey, from convening a Board of Inquiry, pursuant to Sections 800 through 805 of New York Labor Law (McKinney’s 1988), to investigate the ongoing labor dispute between the Daily News and ten labor unions.
