MEMORANDUM OPINION

ROYCE C. LAMBERTH, Chief Judge.

Before the Court are plaintiff’s Motion [16] for Summary Judgment and defendant’s cross-Motion [18] for Summary Judgment. Having carefully considered the Motions, Oppositions, Replies, the entire record in this case, and the applicable law, the Court will grant defendant’s Motion for Summary Judgment and deny plaintiffs Motion for Summary Judgment. A review of the background of the case, the governing law, the parties’ arguments, and the Court’s reasoning in resolving those arguments follows.
