On May 20, 1922, an indictment was filed in the court below against Fred C. Sawyer, C. H. Burlingame, and B. I. Salinger, Jr., for devising about November, 1917, an alleged seheme to obtain money by alleged false and fraudulent promises from the Midland Packing Company, a corporation, and from the purchasers of its stock, and, for the purpose of executing such seheme or attempting so to do, for causing letters to be sent or delivered by the post office establishment of the United States, in violation of section 215 of the Criminal Code (18 USCA § 338).
