Section 13(c) of the Urban Mass Transportation Act of 1964 (“UMTA” or “the Act”), 49 U.S.C.Ápp. § 1609(c) (1982), stipulates that, before federal funds may be awarded to a formerly private but presently publicly owned transit system, the Secretary of Labor must certify that the transit authority has made a “fair and equitable” labor protective arrangement that includes, among other things, provisions ensuring employees of “the continuation of collective bargaining rights.”1 In the present case, *941the Secretary of Labor certified the labor protective agreement of…
