This is an action on the case brought by the plaintiff to recover damages for personal injuries arising out of an automobile accident that occurred on August 23, 1972. After the writ was entered, the defendants filed a motion to dismiss on the grounds that the plaintiff’s writ failed to state a cause of action. The case was submitted to a Master (Leonard C. Hardwick, Esq.) on an agreed statement of facts and the master recommended that the motion to dismiss be granted.
