BALDOCK, Circuit Judge.

Plaintiff Santiago Aramburu appeals the district court’s grant of summary judgment on all claims in favor of Defendants The Boeing Company and Larry Whitesell. We have jurisdiction under 28 U.S.C. § 1291. After reviewing the district court’s memorandum opinion, the briefs on appeal, and the record provided us, we affirm the grant of summary judgment. However, with respect to several claims we affirm using a different analysis from that applied by the district eourt. 1
