GODDARD, District Judge.
In July, 1951, two criminal informations were filed against Colonial Airlines and Sigmund Janas, Sr., charging violations of the Civil Aeronautics Act of 1938, 49 U.S. C.A. § 401 et seq., in that they provided transportation to persons at less than the rates in effect and in that they wilfully falsified and altered books and records required to be kept, by charging off certain disbursements as legitimate operating expenses.
