A suit had been begun by Russell & Co., the appellants herein, against the Metcalf Shingle Company, in the superior court of Skagit county. On the 24th day of Hovember, 1897, a writ of garnishment was issued out of the clerk’s office, directed to the defendant —one of the respondents here—J. P. Millett. The writ was delivered to one Callahan, who was appointed by *213Bussell & Co. to serve the same, Callahan being a competent person to serve said writ if it could he served by a private individual.
