PHILLIPS, Circuit Judge.

M. W. Cave, J. A. Fleming, J. A. Kell, and J. F. Kell, hereinafter referred to as the defendants, were charged by indictment in the United States District Court for the District of Colorado with certain penal offenses against the United States, and deposited with the United States Commissioner at Topeka, Kansas, as security for their bail bond, Liberty' bonds of the face value of $29,000.
