When this ease was here before (116 N. C., 339) the Court set aside the non-suit taken below and held that the plaintiff could maintain an action-as the case was then presented. The Court did so upon the ground that, there being apparently a valid liability of $40,000 against the town of Oxford, the compromise thereof for the sum of $20,000 was not necessarily void, and that the court below erred in non-suiting the plaintiff.
