MEMORANDUM OPINION AND ORDER
BABCOCK, District Judge.
In this action to quiet title to Lewis Creek Road in the County of La Plata, Colorado, plaintiff Ruth Barker (“Mrs. Barker”) moves for partial summary judgment regarding the legal effect of Resolution 1976-84, adopted in 1976 by defendant Board of County Commissioners of the County of La Plata, Colorado (“the County”).
