After examining the briefs and the appellate record, this three-judge panel has determined unanimously that oral argument would not be of material assistance in the determination of this appeal. The tragic accident giving rise to this litigation occurred in San Juan National Forest in Colorado. The decedent Stacey Otteson was a passenger in a jeep returning from a pleasure trip. After traveling down a narrow dirt logging access road which reaches a dead end…
