Now before this Court are the plaintiffs’ and defendants’ cross Motions for Summary Judgment. This case concerns Rhode Island Department of Corrections Regulation 10.07.03 (“the Regulation”), which imposes a monthly supervision fee on criminal offenders sentenced to probation or parole. The plaintiffs challenge the constitutionality and statutory authority for the application of the Regulation to offenders who'were sentenced to probation prior to the Regulation’s effective date.
