Memorandum Opinion
ALBRITTON, District Judge.
This cause is presently before the court on a Motion for Summary Judgment, filed by the Defendant, American States Insurance Company (“American”), on May 28, 1997.
The Plaintiff, Shalimar Contractors, Inc. (“Shalimar”), initially filed this action in the Circuit Court of Montgomery County on September 1, 1995 seeking a declaratory judgment that American has a duty to defend, provide coverage, and indemnify Shalimar in an underlying action filed in the Circuit Court of Montgomery County in which Shah-mar is a named defendant.
