These two cases, and another, Cuthbert Burrell Co. et al. v. People’s Ditch Co. et al., post, p. 795, [188 Pac. 85], were tried together, and there is but one bill of exceptions in all three cases. It was agreed, at the oral argument herein, that these two could and should be treated in one opinion, since they involve the same general issues as to the rights of the Stinson Canal Company and the Crescent Canal Company.
