The plaintiff in error, hereinafter referred to as the defendant, was convicted in the county court o'f Noble county, upon a charge of having in his possession choc beer, 'capable of being used as a beverage, for the purpose of bartering, selling, giving away, and otherwise furnishing the same to others, and sentenced to imprisonment in the county jail for a period of six months and to pay a fine ef $500. Motion for new trial was filed and overruled, and appeal perfected to this court.
