The plaintiff in error Jim Thigpen, defendant below, was charged by information in the county court of Okmulgee county, Oklahoma, with the offense of the unlawful possession of intoxicating liquors consisting of 31 pints of tax-paid intoxicating liquors. The offense complained of was allegedly committed on December 5, 1950. The defendant was tried to a jury, convicted, his punishment fixed at a fine of $250 and 90 days in the county jail; judgment and sentence entered accordingly, from which this appeal has been perfected.
