DAWKINS, District Judge.

Plaintiff in the above cases sued in the state court upon insurance policies issued to the H. & P. Department Store, Inc. (hereafter called Department Store), covering merchandise in a building destroyed by fire at Leesville, Louisiana. Hart alleged that he is the duly appointed and sole Trustee of the H. & P.
