Plaintiff NCB Management Services, Inc. (“NCB”) brings this action against the Federal Deposit Insurance Corporation (“FDIC”), in its capacity as the receiver for Advanta Bank Corporation (“Advanta”), a failed financial institution in Utah that was closed by state authorities in March 2010.
