OPINION

FORSBERG, Judge.

This is an appeal by the Commissioner of Public Safety from an order rescinding the revocation of respondent’s driver’s license under the implied consent law, Minn.Stat. § 169.123 (1984). We reverse.

FACTS

On March 20, 1985, at approximately 11:54 p.m., Police Officer Michael W. Johnson of the St. Louis Park Police Department stopped a motor vehicle driven by respondent on Excelsior Boulevard in St. Louis Park. There were passengers in the vehicle.
