Before the court is defendant’s motion to dismiss Counts I, II, III, IV, V, VI & IX of the Complaint.
Background
This case concerns the relationship between defendant General Motors Corporation (“GM”) and its franchisee, plaintiff Freedman Truck Center, Inc. (“Freedman”). Since 1936, Freedman, a truck dealership, has sold and serviced trucks manufactured by GM pursuant to franchise agreements called Dealer Sales and Service Agreements (“the Dealer Agreement”).
