In the instant action, plaintiff Elementis Chemicals, Inc. (“Plaintiff’ or “ECI”) brings suit under the Comprehensive Environmental Response Compensation and Liability Act of 1980 (“CERCLA”), and under various state-law theories, against defendants T H Agriculture and Nutrition L.L.C.
