This is a suit for foreclosure of a mortgage, brought by defendant in error. The complaint alleged that on May 2, 1895, the defendant executed his promissory note to plaintiff for the sum of $1,260, payable three years after date, with interest; that on the same day, the defendant caused to be conveyed to plaintiff by The Equitable Building and Loan Association, as a part of the same transaction and for the purpose of securing the payment of said note and interest, certain lands in said deed mentioned, situate in Elbert county.
