Currently pending before the court are the motions of defendants Levi Strauss & Company (“Levi Strauss”) and Carl Von Buskirk (“Von Buskirk”), to dismiss the complaint filed by the Equal Employment Opportunity Commission (“EEOC” or “Commission”). The EEOC seeks an injunction barring the prosecution of a state court action by Von Buskirk against Teri Berk, the plaintiff-intervenor, for slander and defamation.
