This case arises out of a workers’ compensation claim filed by appellant, Bennie Earl Gray, on October 28, 1987, due to injuries sustained while allegedly working for co-appellee, Willey Freightways, Inc. (“Willey”), on March 6, 1987. The Lucas County Court of Common Pleas dismissed appellant’s complaint for declaratory judgment under R.C. 4123.515 and 4123.516 and dismissed his request for injunctive relief, on the basis that the court lacked subject matter jurisdiction.
