On the 2d day of June, 1893, in the county of Wood, in this state, Peter Houston was murdered by a person on the outside of his house, by a shot fifed through the closed window soon after the light was lighted in the evening. The next day a neighbor, plaintiff in error Charles Emery, who lived with plaintiff in error WilUam Lord, at the home of the latter, was arrested, charged with the crime, and was duly bound over for trial before the circuit court for Wood county.
