This is an action by a lot owner in the city of Iola to recover treble damages against the Southwestern Bell Telephone Company for cutting trees on his lot without permission *34when the same were not interfering in any way with the use of the telephone line. The jury found by general verdict and answers to special questions in favor of the plaintiff for actual damages. The court rendered judgment for treble damages. The telephone company appeals.
