This matter is before the court on defendant Beazer East Inc.’s (“Beazer”) motion for summary judgment. Following oral argument the parties were directed to file supplemental briefs. 1 Thereafter, the mat ter was resubmitted and is disposed of herein.
For the reasons herein stated, Beazer’s motion is granted in part and denied in part.
