MEMORANDUM OPINION

ELLIS, District Judge.

I

In this CERCLA 1 case, plaintiff, the holder of a mortgage on certain property, seeks to recover from defendants, current and former owners and occupiers of the property, the costs incurred for certain environmental studies of the property. Plaintiff contends these studies were necessary because toxic materials were used and stored on the property for more than thirty years. Also sought by plaintiff is a declaratory judgment for costs yet to be incurred on further studies of the property, as well as any required remediation.
