HEANEY, Circuit Judge.
The Secretary of Labor brought this action under § 17 of the Fair Labor Standards Act, 29 U.S.C. § 201 et seq., seeking to enjoin the defendant from violating the equal pay provisions of the Act. The defendant served a deposition subpoena and written interrogatories on the Secretary, requesting the Secretary to produce investigative reports and notes made by Department of Labor compliance officers, to reveal the identities of persons who had been interviewed concerning the alleged violations, and to produce any written statements obtained from such persons.
