The appeal in this action from the judgment of the Supreme Court is taken by the plaintiff and the defendant, William G. Guernsey. The action was instituted for a partition of the real estate devised by the will of Peter G. Guernsey, deceased. The will was made in the year 1837, and the testator died in 1843. The testator left him surviving three children, viz.: Polly Thompson and Lavinia Guernsey and William G. Guernsey, the appellants, and William B. Guernsey the only child of his deceased son Peter B.
