The reason for this opinion is found in the title to the proceeding. John B. Trevor’s will was admitted to probate January 9, 1891. Proceedings affecting it have been before this court in two other instances. Matter of Stewart, 88 App. Div. 23 ; Matter of Trevor, 119 Misc. Rep. 277. He was survived by his widow, Emily N.
