MEMORANDUM-DECISION and ORDER

HURD, District Judge.

I. INTRODUCTION

Plaintiffs Victoria Leland, Roy Leland, and Maxine Chapin (“plaintiffs”) com- meneed the instant action against defendants claiming violations of their rights under the Fourteenth Amendment to the United States Constitution, and negligence. Plaintiffs contend that defendants’ failure to enforce various laws to remedy certain environmental conditions were negligent and deprived them of their constitutionally protected rights. Defendants now move for summary judgment pursuant to Fed.R.Civ.P. 56. Plaintiffs oppose.
