Action in the district court for Cass county to recover $10,000 for personal injuries. The case was tried before McClenahan, J., and a jury which found a verdict in favor of plaintiff for $4,000. From an order denying a motion for a new trial unless plaintiff consent to a reduction of the verdict to $3,000, defendants appealed.

The plaintiff recovered a verdict of $4,000 in the district court of the county of Cass in an action for damages on account of personal injuries sustained by the alleged negligence of the defendants. A motion for a new trial was made by the defendants on the grounds that the verdict was not justified by the evidence; that the damages were excessive, appearing to have been given under the influence of passion and prejudice; that errors of law were committed at the trial; .and, further, on account of the misconduct of a juror.
