GARWOOD, Circuit Judge:

Defendant-appellant T. Windle Dyer (Dyer) appeals the district court’s denial of his petition for a writ of comm nobis, challenging his 1984 guilty plea conviction for mail fraud contrary to 18 U.S.C. § 1341. We affirm.

Facts and Proceedings Below

On December 2,1982, a federal grand jury returned a one-count indictment charging Dyer with extortion under the Hobbs Act, 18 U.S.C. § 1951.
