MEMORANDUM OPINION
GLEN M. WILLIAMS, District Judge.
This case is presently before the court on two motions to dismiss. One motion, on behalf of Buford E. Shockley, Wythe County, and the Wythe County Board of Supervisors, is filed pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure. The other motion, on behalf of the Compensation Board of the Commonwealth of Virginia and the Board members, is filed pursuant to Rules 12(b)(1), 12(b)(3) and 12(b)(6) of the Federal Rules of Civil Procedure.
